Appeals Court Upholds Ban on Enforcing Trump Travel Restrictions

A federal appeals court Thursday upheld one of two bans on enforcing President Donald Trump's executive order restricting travel from six predominately Muslim countries.

The Fourth Circuit Court of Appeals, based in Richmond, Virginia, voted 10-3 to uphold a ruling by a federal judge in Maryland who declared in March that the president's revised travel order amounted to unconstitutional religious discrimination.

Campaign statements by Donald Trump, who originally called for a ban on Muslim immigration, "provide direct, specific evidence" of what motivated his executive orders — "President Trump's desire to exclude Muslims from the United States," the appeals court said.

The revised executive order "cannot be divorced from the cohesive narrative linking it to the animus that inspired it," the court said in an opinion written by Chief Judge Roger Gregory.

This is almost a textbook example of how not to be an appellate judge -- looking to what is NOT in the text of the order, and imagining that a campaign speech is the true intent.

Imagine if all the leftist rhetoric Obama used were factored in?

The original ban was to last 90 days and was supposedly to give the Trump Administration time to evaluate screening and vetting procedures for travel to the U.S..
"Under these authorities, I determined that, for a brief period of 90 days, while existing screening and vetting procedures were under review, the entry into the United States of certain aliens from the seven identified countries -- each afflicted by terrorism in a manner that compromised the ability of the United States to rely on normal decision-making procedures about travel to the United States -- would be detrimental to the interests of the United States."-Trump

Well, 90 days has gone by without his ban and nothing happened, which demonstrates that in fact his ban was unnecessary.
Meanwhile, has Trump used that 90 days he pretended was needed to do anything at all about evaluating screening and vetting procedures.
Of course not. He never intended to do anything. If he had, it would have been done a month ago and we would have seen his proposals.

Secondly, Trump claimed he needed 120 days to evaluate refugee vetting and screening.
"(iii) Executive Order 13769 also suspended the USRAP for 120 days. Terrorist groups have sought to infiltrate several nations through refugee programs. Accordingly, I temporarily suspended the USRAP pending a review of our procedures for screening and vetting refugees."-Trump

120 days have nearly gone by without incident and Trump still hasn't done a thing about evaluating those polices.
He was never going to do anything or it would be done by now.
Trump was only pandering to his base of xenophobes and religious bigots who aren't smart enough to notice there has been no action on the issues Trump claimed to be concerned about.

And now you clowns are mad at the judges instead of being mad at Trump for not doing anything in those 90 and 120 day periods.
In other words, everything is just par for the course for the dimwitted Right.

If you make murder legal in a certain jurisdiction, and 90 days passes without one, it doesn't mean the law is superfluous.

The order was very, very clearly constitutional.

What the court did was look somewhere else, to a political speech.

That's simply insane.

In other words, the judges simply asked themselves whether they were Democrats and found they were.

Now, address the simple point: Trumps said he needed 90 days, Trump has had 90 days, but Trump has done nothing to address what he tried to convince us were critical concerns for America.
Apparently that was a lie or we would have the results of Trump's important evaluations by now.
Do you agree or disagree that Trump has done nothing to evaluate vetting and screening practices since he hasn't released any changes in 120 days?

Hopefully, Trump staffers have been busy revising the procedures.

But it is genuinely shocking that an appellate court would just quit the business of judging what the order said, and look behind the order to see if they liked the politician or what he might said on the campaign trail.

That is simply resigning your job and playing politics.
