The Marital Testimony Exception (in their State) a court can't allow the testimony of a spouse to be entered into the record unless the party on trial consents to its disclosure. Therefore, even if Weiner was willing to reveal damaging information about Huma, unless she consents, the testimony can't be used against her. There also what's called a Notice of Exception, If a spouse knows that his or her spouse is trying to testify against him or her, the affected spouse must provide notice of his or her desire to assert the exception a certain amount of time before the testimony is heard. If the crime was committed against him or her, such as in cases involving domestic violence a spouse can't invoke the Marital Testimony Exception. As long as they're still married they can scheme, discuss their defenses and what they plan on doing to conceal the crimes and not have to worry about the court obtaining that information.

Since you think Huma is going to be tried for breaking Federal law, she would be tried under Federal rules, not state rules. And those rules allow a spouse to testify if he/she chooses.
