AUSTIN – Gov. Rick Perry was indicted on two felony counts for abuse of official capacity and coercion of a public servant late Friday by a Travis County grand jury.

The case stems from Perry’s vetoing the $7.5 million biennial funding for the Travis County Public Integrity Unit last year. He threatened to withhold the money unless District Attorney Rosemary Lehmberg resigned.

In announcing the indictment, special prosecutor Michael McCrum of San Antonio said he felt confident of the charges brought against the governor and was “ready to go forward.”

Mary Ann Wiley, general counsel for the governor, said that Perry is being charged for exercising his rights and power as governor.

“The veto in question was made in accordance with the veto authority afforded to every governor under the Texas Constitution. We will continue to aggressively defend the governor’s lawful and constitutional action, and believe we will ultimately prevail,” Wiley said.

In announcing the indictment, McCrum said that he weighed the duty he had in looking at a sitting governor.

“I took into account the fact that we’re talking about the governor of a state and the Gov of the state of Texas, which we all love. Obviously, that carries a level of importance. But when it gets down to it the law is the law and the elements are the elements and the analysis is whether the facts meet the elements of the offense.

Perry made it clear in public and through emissaries that he didn’t believe the state should fund an office headed by someone who had lost the public’s trust. He pointed to Lehmberg’s April 2013 arrest for drunk driving, which included her video-taped, belligerent conduct while being booked into the jail.

At the time, the Public Integrity Unit, which investigates and prosecutes public corruption and malfeasance, was examining one of Perry’s signature projects. If she had resigned, Perry would have appointed her replacement.

Lehmberg, who had pled guilty, fulfilled her 45-day sentence and completed a treatment program, refused to resign. Perry vetoed the money.

A special prosecutor, Michael McCrum was appointed to look into the case and the current grand jury has been studying the charges since April.

At issue was whether Perry was simply playing typical political hardball or whether he crossed a line by threatening a public official to take an action – resigning – by which he might benefit.

The grand jury is looking at potentially three state statutes: whether the longtime Republican governor tried to bribe a public official into stepping down; if he abused his position by misusing public funding “to obtain a benefit”; or whether he tried to coerce Lehmberg into taking “a specific performance of [her] official duty.”

Perry’s office has defended his actions, saying he exercised his constitutional authority to veto appropriations.

A half dozen of Perry’s staff has appeared before the grand jury, including his budget expert, legislative liaison, deputy communications director and criminal justice advisor.

Obama's IRS actually admitted to targeting political enemies, then the IRS "lost" all the relevant email.

Obama lied about Obamacare, and has pretty much lost Iraq.

Obama racked up more debt than any other president, and U-6 unemployment is 12.2 percent, with 47 million on food stamps.

There is video tape of the drunken Ms. Lehmberg cursing, kicking her jail cell, demanding that someone call the sheriff, and even going so far as to sticking her tongue out. In short, acting just like your average liberal ass wipe. This will make great theater when introduced as evidence into court.

Perry was fully within his rights, as guaranteed by the Texas Constitution, to use his line item veto to deny funding for a ethics bureau led by this drunken, outrageous, idiotic woman.

David Axelrod, a senior aide and confidante to President Obama, wrote: "Unless he was demonstrably trying to scrap the ethics unit for other than his stated reason, Perry indictment seems pretty sketchy. I just don't see it holding up."
The American public is tired of Obama and other politicians abusing our system and ignoring the Constitution, you can bet this will push even more people over the Republican's side in the next election. :D

The charges stem from a 2013 scandal that has been quietly rumbling in the Lone Star State as Perry has been floated as a viable contender for the Republican nomination in 2016.

This is a complex case, which might be why it has not made national headlines the way other recent, state-level scandals (like Bridgegate, in New Jersey) have. Below, I have outlined a somewhat confusing short version of events, and a longer, more colorful explanation that involves alcohol, police, and masks.

The short version is this: A Democrat refused to resign from her position as District Attorney, where she controlled the state’s Public Integrity Unit, an entity which investigates ethics violations of elected officials. The likely reason why is that Perry, a Republican, would have almost certainly installed another Republican. One of the few positions in control of a Democrat under Perry’s watch would’ve vanished—a big deal, given the power of the Public Integrity Unit.

Perry, as a means of intimidating the DA into resigning, publicly threatened to veto the Public Integrity Unit’s budget. And when she didn’t step down, he made good on his tough talk, gutting all of its funding ($8 million) for two years.

From the outset, Perry was adamant that what he did was not illegal—which is presumably why he made no secret of it. But his opponents were not convinced. In August, an investigation into the matter began, which resulted in today’s indictments.

Exactly, he did nothing wrong. Travis County District Attorney Rosemary Lehmberg is a piece of shit that should not be in charge of a unit overseeing misconduct of others. After her arrest for drunk driving, she threw out names of people she knew, threatened to get officers fired and even attack one of the officers. She lost Rick Perry's support, he is the one responsible for the State of Texas, she has no place in a position of authority.

"He may well avoid conviction on the charges that have now been brought against him a result of that maneuver, and who knows, may still resume his post-2012 comeback and mount a second run for president. Rick Perry of Texas is one of the least thoughtful and most damaging state leaders in America, having done great harm to immigrants, abortion clinics and people without health insurance during his 14 years in office. But bad political judgment is not a felony, and the indictment handed up against him on Friday — given the facts — appears to be the product of an overzealous prosecution.

For more than a year, Mr. Perry has been seeking the resignation of the Travis County district attorney, Rosemary Lehmberg. He had good reason to do so: Ms. Lehmberg was arrested in April 2013 for driving with a blood alcohol level of more than three times the legal limit, and she verbally abused the officers who found her with an open bottle of vodka. She ranted and raved at the local jail, threatening sheriff’s deputies, and she had to be restrained in a chair with a hood over her head. She pleaded guilty and was sentenced to 45 days in jail. In addition to endangering people’s lives, she instantly lost her credibility as a prosecutor of drunken-driving cases.

After the arrest, Mr. Perry told Ms. Lehmberg that if she didn’t resign, he would cut the financing for the Public Integrity Unit. In June, he did just that, using his line-item veto to zero out the $7.5 million for the unit. But his ill-advised veto still doesn’t to rise to the level of a criminal act. After a complaint was filed by a liberal group, a judge appointed a special prosecutor, Michael McCrum, a San Antonio lawyer and former federal prosecutor, to take the case. A hand selected Travis County grand jury indicted Mr. Perry on two felony counts: abuse of official capacity and coercion of a public servant. The indictment says he exceeded his veto power by combining it with a threat to Ms. Lehmberg if she didn’t quit.

Governors and presidents threaten vetoes and engage in horse-trading all the time to get what they want, but for that kind of political activity to become criminal requires far more evidence than has been revealed in the Perry case so far. Perhaps Mr. McCrum will have some solid proof to show once the case heads to trial. But, for now, Texas voters should be more furious at Mr. Perry for refusing to expand Medicaid, and for all the favors he has done for big donors, than for a budget veto.

Jail house lawyers toss around legal terms without an understanding of what they mean. A statute of limitations only applies to the time period limits where prosecution can be brought, it doesn't mean after that time it didn't happen.
