Republicans in the House of Representatives say they want to fix overtime pay for federal and state employees. It's just not clear what about that pay system is broken.

The GOP is pushing legislation that the Associated Press says would allow employees who work more than 40 hours a week the option of taking paid time off instead of overtime pay. It seems fairly straightforward on paper and such a policy has existed in the private sector for years. It's also a means of cutting into workers' compensation and lining state and federal coffers, according to the bill's opponents.

The new legislation takes dead aim at the at the Fair Labor Standards Act of 1938, which requires covered employees to receive time-and-a-half pay for every hour over 40 within a work week. The proposal would reduce that take to straight-time comp days.

The bill would allow workers to bank up to 160 hours, or four weeks, of comp time per year that could be used to take time off for any reason. It would let an employee decide to cash out comp time, and it forbids employers from coercing workers to take comp time instead of cash.

Still, Democrats say the bill doesn't guarantee that workers would be able to take the time off when they want. It also gives employers the final say on comp-time requests, which could make that time difficult to cash in. Also, the bill's opponents argue that allowing workers to bank their leave time essentially gives employers an interest-free loan from employees.

Also, opponents are aware that Republicans and members of the business community have been trying this route around the Fair Labor Standards Act since the 1990s and have been shot down at every turn. House Majority Leader Eric Cantor, R-Va., has reintroduced the measure as part of a bid to woo working families, but worker advocates say those same families should be wary of the bills budget-sheet origins.

Judith Lichtman, senior adviser to the National Partnership for Women and Families, told the AP that the program was created in the public sector in 1985 as a cost-cutting measure that has since been framed as an option that provides workers greater flexibility. As she notes, many workers in federal and state government are unionized or have civil service protections that give them more leverage in dealing with supervisors.

The banked-time plan took hold in the private sector largely because similar worker protections don't exist there.

Brandon, you seem to have missed this critical part:

SO, the employee gets to determine if they want 160 hours of PAID TIME OFF at a later date or if they want PAID as usual.

Either way, they get PAID for the time, but, they can choose to have TIME OFF (WITH PAY) if they want - I personally loved Comp-Time when I was working for a company that offered it - and they calculated our Comp-Time as Overtime, not regular time.

Private individuals have been forced to find ways to cut back during Obama's leadership, I think it's a good thing that someone is finally asking public workers to join us in the sacrifices so that we can keep more of our tax dollars. While the net worth and income of private individuals have gone down by an average of 20% the income of public workers has went up over 20% and increases in Federal spending on salaries has went up 30%. There's a real problem and tax payers need to stop the madness even if that means a tax revolt.

Conservatives for years have been trying to cut into the 1 1/2 time overtime pay for the working stiffs.

They are more interested in preserving the tax cuts for the rich rather than preserving the benefits for the middle class.

It doesn't seem that the donations that the Chamber of Commerce have made to the Republican party have been paying dividends...

Actually we've been working to get full time jobs for everyone. Obama has given us less full time jobs and double the part time jobs. Who in the hell gets overtime outside of the Government? You have Government workers getting overtime pay because they didn't do their job during work hours, it's time to demand more of our Government.

Most new jobs are under 30 hours, thanks to Obamacare. Less hours and now no medical coverage, you liberals got what you demanded. So what you have are millions of people now working two part time jobs with no benefits and certainly no overtime. I haven't hired a full time worker in over 2 years but I have a lot of part time workers now, as full time workers leave I replace them with part time workers. Liberals thought they would shaft businesses with Obama's agenda...well it's backfiring on you dudes.
