Predictably, the Federal Circuit upheld an earlier ruling by the Court of International Trade finding that the tariffs' legal basis under an emergency was wrong.
Of course, there were several reasons why this was predicatble. First, most of the judges of the Federal Circuit are Democrats who presumably hate Trump. Secondly, they defer to the lower court and its supposed subject matter expertise.
However, if a president can draft you out of grad school and send you into the largest war of your lifetime (in which tens of thousands of men died), then it is difficult to argue that a president could not declare a trade emergency.
Despite the Trump Derangement Syndrome which was eroded the rationality of Elkin and Clown, if a president lacked such trade authority, who would have it? The Pope? Taylor Swift?
