"President Barack Obama's administration faces a difficult and possibly lengthy legal battle to overturn a a Federal court ruling that blocked his landmark immigration overhaul.

"In his ruling on Monday that upended plans to shield millions of people from deportation, US District Judge Andrew Hanen avoided diving into sweeping constitutional questions or tackling presidential powers head-on. Instead, he faulted Obama for not giving public notice of his plans. The failure to do so, Hanen wrote, was a violation of the Administrative Procedure Act, which requires notice in a publication called the Federal Register as well as an opportunity for people to submit views in writing. "

The Court also pointed out that President Obama acknowledged on 22 previous occasions that he doesn't have the authority to do what he's trying to do. "President Obama rightly told citizens, that he does not have the power to do what he is now trying to do, nothing has changed since his speeches that would now grant him those powers."
Judge Hanen found that President Obama acted legislatively, and he does not have that power.
There is no issue that illustrates the vote pandering or patron pleasing compulsions of the clowns that control our government than this one. Going around the Constitution and ignoring our laws to allow millions of illegals to stay in our country is nothing but vote pandering.

So the right wing goes judge shopping...in Texas of course, and finds a right wing judge who imposed an injunction because of a technicality!!!

Yep that Constitution is a technicality that's been getting in Obama's way since the day he took office.

Under the APA, Obama could still get away with his approach if he just issued a general order to the effect, say, that "Illegals are dandy."

But Obama's plan was to give SSNs to illegals, to spend tons of money giving them special work/live status in America, and generally rewarding them for breaking the law.

In other words, Obama was legislating by exec order, which meant he had to embark upon notice and comment rulemaking.

As Obama said 22 times, he lacked authority to grant amnesty.
