“[T]he Presidential records of a former President shall be available to such former President or the former President’s designated representative.” 44 U.S.C. § 2205(3).

It doesn’t matter whether his presidential records are national-defense information or marked classified.

That is why Congress funds the Office of the Former President, with secure office space, staff with clearances, and Secret Services protection.

Former presidents don’t get to access any classified or national-defense information they want.

But they have an absolute statutory right to access their presidential records, even if the government owns them.

And former presidents can share their presidential records with their designated representatives.

Media outlets believe a former President of the United States (somehow) commits “espionage” for simply retaining copies of his personal or presidential records.

It does not seem so, but future legal rulings will prove interesting."

No classified documents are the personal "Presidential records" of any president. (Like most partisan tools, you're confusing "Presidential Records" with "personal records." Not the same thing, dimwit.

So even if Trump has a right to "access" those documents, he still does not have the right to abscond with them, and especially he can't store them beside the toilet and a photocopy machine at his home where he entertains Chinese agents.
The dimwit he had to be told to finally put a lock on the doors, fer cripes sake, which he only grudgingly did. Too little too late. He also showed reporters classified information in his Bedminster home.

johnny, allowing Chinese agents and reporters access to classified documents absolutely violates the Espionage Act.

Why is johnfoibles going down that diversionary rabbet hole which has nothing whatsoever to do with Trump's prosecution.

And if Trump's team takes that delusionary road, he's toast.

Any president can declassify at any time per the PRA.

The Espionage Act of 1917 was related to WW I spying, which -- needless to say -- is not germane here.

Neither Clinton nor Obama nor Bush Jr got charged for their sloppy handling of millions of pages of docs.

Trump has not been charged with "sloppy handling" of classified documents, so what's your point?

Trump himself admitted he didn't declassify the documents before leaving office, so your point is moot.

And the Espionage Act of 1917 is still the law. Whatever you think the law was "for" at the time is irrelevant.
Besides, the Trump Administration prosecuted people based upon it, so clearly Trump thinks it is still in force.

Why you DON'T think the law is the law is a mystery, since you claim to be a lawyer. Simply trying to shrug it off with an irrelevant comment doesn't mean shit to the government. I'm sure a clown like you tried to insist you didn't have to pay income tax and then got hit with a hefty fine---THAT YOU THEN PAID.
