Prosecutors accuse Trump of scheming with his valet, Walt Nauta, and a Mar-a-Lago property manager, Carlos De Oliveira, to conceal the footage from federal investigators after they issued a subpoena for it. Video from the property would ultimately play a significant role in the investigation because, prosecutors said, it captured Nauta moving boxes of documents in and out of a storage room — including a day before an FBI visit to the property. The boxes were moved at Trump’s direction, the indictment alleges.

According to the indictment, Nauta met with De Oliveira on June 25, 2022, at Mar-a-Lago, where they went to a security guard booth where surveillance video is displayed on monitors and walked with a flashlight through a tunnel where the storage room was located, observing and pointing out surveillance cameras.

Two days later, according to the indictment, De Oliveira walked through a basement tunnel with an unidentified Trump employee to an audio closet, where De Oliveira in a private conversation asked how many days the server retained footage.

De Oliveira, prosecutors said, told the employee that “the boss” wanted the server deleted and asked, “What are we going to do?”

During a voluntary interview with the FBI last January, prosecutors say, De Oliveira lied when he said he “never saw nothing” with regard to boxes at Mar-a-Lago.

De Oliveira was added to the indictment, charged with obstruction and false statements related to that FBI interview. His lawyer declined to comment Thursday evening.

This doesn't mean that the prosecution by Smith was merely political as johnfibs alleges. The conviction wasn't thrown out because anyone actually believed McDonnell wasn't corrupt. He clearly is. The quid pro quo wasn't even disputed. They only quibbled over what should be considered an "official act". In other words, it was reversed on a technicality and sent back to the lower court to be retried if the prosecutors could demonstrate McDonnell's actions were "official acts" under a new narrower definition.

This is an example of what johnforbes considers to be "disinformation." What johnny said is true as far as he goes, but he conveniently leaves out the inconvenient facts that show him to be lying by omission.

The letter by 51 intel experts that he says is "disinformation" consists of all true statements. Everything written in the letter is true and johnforbes still calls it disinformation. In other words, johnforbes considers the truth to be disinformation. Thus, johnforbes' own true comment can also be considered to be disinformation. The difference is, johnforbes' comment, unlike the intel expert letter, contains only part of the truth; the part that supports his partisan political position. This sorry fact is what makes johnforbes a peddler of partisan disinformation. He continues to willfully hide the rest of the facts and pretend they don't exist.

When you learn the facts of the McDonnell case it becomes clear that Smith's prosecution was in no way frivolous, and thus not merely "reckless and partisan." Smith only lost (temporarily) on a technicality. The case hinged on a legitimately debatable definition of terms and not on the facts of the case. The Court didn't exonerate McDonnell as johnforbes is implying. And the Court with its decision didn't 'reprimand' Smith for prosecuting the case, as johnforbes is also implying. johnforbes' corrupt candidate of choice may yet be found to be as corrupt and guilty as Justice Roberts and the rest of the Court knows that McDonnell is.
