The flaw in the entire Mueller probe is the failure of the original letter, and Rosenstein's secret additional letter, to fulfill the requirement of stating a crime to be investigated.
Since 1815, it was accepted as wrong to just say "I don't like John Jones" and then go investigate him and hope to find something he did wrong and prosecute that.
On a related note, they are trying to determine whether the entire Russia thing may have originated with people who, like apparently Brennan did, shopped the story around to Harry Reid. Why would a neutral intel person shop a story around to Harry Reid?
